The subject of this Distance Sales Agreement (the "Agreement") is the determination of the rights and obligations of the Parties, in accordance with the provisions of the Consumer Protection Law No. 6502 (the "Law") and the Distance Contracts Regulation (the "Regulation"), with respect to the sale and performance of the service ordered electronically by the BUYER through the website and customer panel of the SELLER, the characteristics and sales price of which are specified in the order summary.
This Agreement has been prepared for BUYERS who qualify as "consumers" within the scope of the Law and the Regulation. Provisions specific to consumer legislation do not apply to BUYERS acting for commercial or professional purposes; for such BUYERS, the provisions of the Service Agreement apply.
3. Main characteristics and price of the service
- The services offered by the SELLER are domain name registration, transfer and renewal, web hosting (shared, cPanel/Plesk), reseller hosting, VPS, VDS, game servers, dedicated (physical) servers, Sectigo SSL certificates, corporate e-mail and TÜRKPATENT (Turkish Patent and Trademark Office) trademark registration consultancy services. Software development, mobile application, website design and digital marketing (advertising management) services are outside the scope of this Agreement; these services are subject to a separate project agreement and, where necessary, separate preliminary information.
- The type of service purchased, the package name, the technical specifications (disk space, bandwidth, processor, memory, number of e-mail accounts, etc.), the service term, the unit price, the quantity and the total sales price including VAT are shown in the order summary, which forms an integral part of the agreement.
- Prices on the website are displayed as "+VAT", and the total amount payable by the BUYER, including taxes, is clearly stated in the order summary before the order is confirmed. No separate delivery charge is requested from the BUYER for the performance of the service.
- Domain name registration fees, TRABİS (Turkish .tr domain name registration system)/ICANN fees and the official TÜRKPATENT fees relating to trademark applications are shown separately in the order summary.
- For fixed-term services, the term of the agreement is the selected service period (monthly, annual, etc.). Unless the BUYER chooses otherwise, the service is renewed for the same period at the end of the term; the renewal fee is notified to the BUYER in advance by means of a renewal invoice. The BUYER may cancel a service that it does not wish to renew through the customer panel before the end of the term.
4. Method of payment
- Payment is made by bank transfer/EFT to the SELLER's bank account listed on the Our Bank Accounts page or, where offered in the customer panel, by credit/debit card.
- For bank transfer/EFT payments, the order or invoice number must be entered in the description field. Performance of the service begins upon confirmation that the payment has reached the SELLER's account.
- Card payments are processed through licensed payment institutions; card details are not stored by the SELLER. For payments in instalments, the conditions applied by the bank are subject to the agreement between the BUYER and the card-issuing bank.
- The invoice is issued electronically on the basis of the information declared by the BUYER and made available in the customer panel.
5. Performance of the service (delivery)
- The services do not involve any physical delivery; they are performed electronically. The place of performance is the BUYER's customer panel and registered e-mail address.
- Web hosting and corporate e-mail accounts are, as a rule, activated automatically upon confirmation of payment, and the access details are sent to the BUYER's e-mail address.
- Domain name registration and renewal transactions are initiated immediately with the relevant registrar and registry operator upon confirmation of payment. Transfer transactions are subject to the approval and waiting periods provided for in the applicable rules.
- VPS, VDS, game servers and dedicated (physical) servers are delivered once their setup has been completed following confirmation of payment. SSL certificates are issued once the BUYER has completed the certificate authority's validation process. In trademark registration consultancy, the application is filed with TÜRKPATENT after the BUYER has provided the necessary information and approval.
- Pursuant to Article 16 of the Regulation, the SELLER performs the order within the periods stated above and undertaken during the order, as from the date on which the order reaches it. If performance of the service becomes impossible, the SELLER notifies the BUYER within 3 days of becoming aware of this situation and refunds the amount paid within 14 days.
6. Right of withdrawal
Pursuant to the Law and the Regulation, in distance contracts the consumer, as a rule, has the right to withdraw from the contract within 14 days without giving any reason and without paying any penalty. In service contracts, this period begins on the day the contract is concluded.
Exception to the right of withdrawal: Pursuant to sub-paragraph (ğ) of the first paragraph of Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for contracts relating to "services performed instantly in electronic form" and, pursuant to sub-paragraph (h), for contracts relating to services whose performance has begun with the consumer's approval before the withdrawal period expires. The domain name, web hosting, server, SSL certificate and corporate e-mail services offered by the SELLER begin to be performed instantly in electronic form upon confirmation of payment.
During the order, before the payment step, the BUYER, by ticking the relevant consent box, expressly confirms that it requests the performance of the service to begin immediately and that it is aware that it therefore cannot exercise the right of withdrawal. The order cannot be completed without this confirmation.
For the trademark registration consultancy service, the BUYER may exercise the right of withdrawal until performance of the service begins with its approval; for a service whose performance has begun, the Refund and Cancellation Policy applies. In the event of withdrawal, the price is refunded within 14 days of the notification reaching the SELLER.
Voluntary refund commitment: Without prejudice to the exception to the right of withdrawal, the SELLER offers a refund within 15 days of the purchase date for shared web hosting services (excluding reseller hosting). Domain names, SSL certificates, server licences and official fees (TRABİS/ICANN/TÜRKPATENT fees) are outside the scope of this commitment. The refund conditions and application procedure are set out in the Refund and Cancellation Policy.
Where the right of withdrawal can be exercised, the BUYER may submit the withdrawal notice within the prescribed period to the e-mail address [email protected], through a support ticket in the customer panel, or in writing to the address Hacı Abdi Mah. Sofa Sk. No:40/7 Battalgazi / Malatya. In this case, the SELLER refunds the amount collected within 14 days of the date on which the withdrawal notice reaches it, using a method appropriate to the payment method used by the BUYER.
7. Rights and obligations of the parties
- The BUYER accepts that, before placing the order, it has read, understood and electronically confirmed the Preliminary Information Form regarding the main characteristics of the service, the total price, payment and performance details and the right of withdrawal.
- The SELLER is obliged to perform the service in full, in accordance with the characteristics specified in the agreement and the order summary, and in compliance with the legislation.
- The BUYER is obliged to use the service in compliance with the Acceptable Use Policy set out in the Service Agreement and with the legislation. In matters not regulated by this Agreement, the provisions of the Service Agreement apply, provided that they are not to the detriment of the consumer.
- Domain name registration is subject to ICANN and TRABİS rules, and trademark registration is subject to TÜRKPATENT decisions. The decision on trademark registration rests with TÜRKPATENT, and the SELLER does not guarantee the outcome of the registration.
- The BUYER's personal data is processed within the scope of the KVKK Privacy Notice (KVKK: Turkish Personal Data Protection Law No. 6698).
8. Default and its legal consequences
- If the BUYER fails to pay renewal or fixed-term service fees when due, the SELLER may take action according to the schedule set out in the Service Agreement (suspension on the 7th day after the due date, termination and deletion of data on the 30th day). The BUYER is notified by e-mail before suspension and deletion.
- For card payments, if the BUYER defaults vis-à-vis the card-issuing bank, the provisions of the credit card agreement between the BUYER and the bank apply.
- If the SELLER fails to perform the service within the agreed period, the BUYER has the right to rescind the agreement and request a refund of the price paid within the framework of the general provisions of Law No. 6502 and the Turkish Code of Obligations No. 6098.
9. Complaints and dispute resolution
The BUYER may first submit its requests and complaints regarding the service to the e-mail address [email protected], by phone at +90 (422) 333 01 12, or through the customer panel support system.
In disputes arising from this Agreement, the BUYER may apply, within the monetary limits determined and announced each year by the Ministry of Trade, to the Provincial or District Consumer Arbitration Committees at the place where the goods or services were purchased or where the BUYER resides, and, for disputes exceeding these limits, to the Consumer Courts. Applications may also be made via e-Devlet (the Turkish e-Government Gateway) through the Consumer Information System (TÜBİS).
10. Entry into force
- During the order, the BUYER electronically confirms that it has read and accepted all the terms of this Agreement and the Preliminary Information Form. The Agreement is concluded and enters into force upon the BUYER's confirmation of the order.
- After its conclusion, the Agreement and the order summary are sent to the BUYER's registered e-mail address by means of a durable medium and kept accessible in the customer panel. The SELLER retains the agreement and confirmation records for the period prescribed by the legislation.
- This Agreement, consisting of 10 articles, entered into force on the date it was electronically approved by the BUYER.
